CLEAR Rule 14 Patient Bill of Rights and Federal Regulations VIOLATION

I was threatened with discharge if I went outside in the wheel chair or left the floor. Which clearly violated the Patient Bill of Rights posted on their wall in the hallway on the floor of the wing I am currently admitted to for a severe motorcycle accident where my pelvic bone had to be reconstructed with screws and plates both horizontally and vertically, my right leg was broken, my L-7 and L-11 vertebra were severely fractured. I looked up the laws for their own facilities regarding patient rights and they violated my Patient Bill of Rights which is clearly outlined on their own website. This, in line then followed by the FEDERAL REGULATIONS regarding Patient rights. I called my lawyer, they still have yet to produce any policy where is says they will discharge me if I do so and go outside and smoke a cigarette or even get fresh air. I cannot walk, or put pressure underneath my feet for another 2 months at least. They threatened discharge with no policy produced, and no plan of transfer, or real validity to their downright violation. So what happened step by st ep, I get ready, I get myself into the wheel chair with all my braces, supports, and medical protocols for me moving about being met. I start to proceed towards the elevator, and all hell breaks loose. They blocked me from hitting the floor button by holding down the top floor button and standing in the elevator door way so the doors wouldn’t shut. They called a Code 5 whatever that is. I am not a mental patient, a criminal, or under arrest, or incapable of operating the wheelchair on my own. They tried to produce a smoking policy which only backed my side and destroyed their false claim of no smoking allowed anywhere, it plainly stated 30 ft from any ground floor entrances. They still have not produced the policy in writing that states they have a right to violate and superceed my federal and state patient rights and discharge me in retaliation if I go outside and smoke, or even get fresh air. My rights are clearly violated and I will be seeking damages for the stress, public display of force by a security team of 5 security guards for no reason, even my doctor said if the policy says he you can discharge then by all means discharge but, I don’t have any issue with him going outside and smoking, or getting fresh air or both for that matter. My blood is boiling in short. I am being restrained with the threat of retaliation of me trying to exercise my state and federal regulatory rights. What do I do????? This happened at O’Connor Hospital in San Jose, CA at 5pm on 2/7/2023 -Daniel Boyer
